Make Transcripts of Phone Conversations
Once you have been given an arbitration hearing date, make a transcript of the conversations you have taped and submit this as evidence to the arbitrator (with a note saying you will provide audio tapes of the conversations, if necessary). Without knowing too much about the law involved regarding taped phone calls, I suggest this method as an alternative to actually submitting the tapes themselves. If the manufacture knows you have audio tapes and can show what has been said, they will be less likely to question your reference to the conversations.
